In what’s almost an end to a year like no other, comes again more COVID-19 updates.
No, we’re not talking case numbers in Australia, but rather the updates to the emergency residential rental laws and moratorium (temporary prohibition) on evictions.

Remember way back when?
The original update which was going to impact the players in the residential market, be they tenant, landlord or property manager, was the Federal Government’s announcement on the 29th of March 2020 that there would be a 6-month Moratorium on Evictions due to COVID-19.
The Covid-19 Emergency Response Period was well over 6 months ago: what happens now?
· The Moratorium on evictions ended (for some states) on 29th September 2020,
· However, the RTRA (COVID-19 Emergency Response) Regulation 2020 isn’t set to expire until 31st of December 2020.
This means some regulations still apply, while others won’t, and of course, to stand-by for anticipated further amendments and changes to tenancy laws amidst the pandemic.
What about WA?
Although the moratorium on evictions was set to finish in Western Australia on the 29th of September 2020, it has now been extended until 28th of March 2021.
After all, nobody really knew (or knows) how long the pandemic and its economic impact would last.
What tenants and landlords can do:
· The State Government is encouraging landlords and tenants to come together through their property management Perth team to negotiate rent deferrals, reductions or vacating a fixed lease without penalty.
· If no mutual agreement is made, the matter may be presented to the Commissioner for Consumer Protection.
· Tenants can still be legally evicted, or leases terminated if damage is caused to the property, pose a threat to neighbours or landlord, abandon the property, refuse to make a rent payment agreement or refuse to make a rent payment when not financially affected by COVID-19.
We’re very lucky in WA to record low cases this far into the pandemic and hopefully continue in our efforts to stop the spread.
